View Full Version : TO THOSE FILING A LAWSUIT

If you are filing a lawsuit then your role on this forum completely changes. Please abide by these rules to keep yourself out of trouble. Contact me or Jeffrey if you have any further questions.

Do not turn your lawsuit into an instrument for personal revenge or financial gain. If it can be proven that you are in it for the money or to fulfill some vendetta, then you seriously injure your reputation before the judge as a class representative. Worse yet, you might be counter sued. Also, when you address the case, refer to the company's name, not the site owner's name.

Do not interfere with the business relations between the pay companies and the matrix sites. You can be liable for a countersuit for meddling in the business interactions between two entities. This means not "ordering" people to get refunds. If people want to get a refund, then tell them to contact the site owner and the pay company. Other people might get away with crossing this line, but if you are now a plaintiff, don't risk it. You may, however, encourage people to get involved with the lawsuit.

When you respond to questions or comments about the matrix site in question, stick to the issues of the case. Refer all confusing questions to your lawyer. Do not try to answer them yourself if you don't know how the case answers it already.

You may receive phone calls and emails from people claiming to be matrix-site owners, fellow class-action members, lawyers, or writers from the press. Do not answer their questions. Refer all questions to your lawyer. It will be tempting to tell them a few details, but DON'T do it. Jeffrey, or the lawyer handling your case, will be able to sort through the issues and deal with the essential matters. The reason for this is that these people who contact you may very well be lawyers from the other side posing to be someone else. It happens, even thought it is wrong.

Don't accuse the defendants of any wrong doings. Just state what the case alleges, but do not say something like, "X site has committed a crime", or, "X person is guilty of running an illegal lottery". Our claims are still yet to be proven in court, and these site owners are innocent until proven guilty.

If there is too much to think about here then just remeber one thing: Refer all questions and issues to your lawyer.

You can never go wrong with that.

Once you get the feel of how you need to conduct yourself in light of these rules you will slowly be able to speak with confidence. It is okay if you feel a little "crippled" when answering people's questions while you acclimate to the learning curve. Just continue to speak to your lawyer more, and read through this site, you'll get your groove going. Thanks for taking our campaign to the next step.

This is a quick update for those of you who have filed a lawsuit against a matrix company and their pay provider. Do not, I repeat, do NOT answer too many questions that your lawyer has not already given you an answer to. It does not take much to throw a wrench into your case by answering a question the wrong way. When you get an email or a post on the forums about refunds from the pay processors, other lawsuits, the consequences of your lawsuit, etc. just refer all the questions to your attorney. Refer them to him because he or she will be able to supply an answer that does not jeopardize your position as a plaintiff.
