There is a complaint section on this MSN forum where people announce site closures. Please inform these people about their rights and MatrixWatch.org. I believe that these people deserve to get their money back, and should not be left in the tire tracks of a runaway-matrix site. It is highly likely that the pay companies still have their money sitting an account, but the people will need to act fast! Have them contact either their lawyer, or mine (wilens@cox.net).

Here is another site that has shut down http://www.jmlist.com they state they have shut down because of the lawsuit against ezexpo and because Ginix has now frozen their account. They do advise everyone to get a refund from Ginix.

I've listed a few more Ginix-freeze sites. I've also included the URL link to a space on that site where you can see evidence of Ginix freezing their account. If the link leads you to a page with red script, then just look at the URL address bar and notice that it says "ginix.com". These pages were what popped up when you pressed the "Add to Cart" button on their site. It is a shame that so many customers of a few of these sites will hear about this news for the first time here.

There are other sites that I know have frozen accounts, but they have quickly switched pay providers and have removed all traces of Ginix from their pages. These sites have not told their current customers that their money has been frozen either. I think that is totally dishonest. I know exactly which sites are doing this, and I am calling on those site owners to immediately post the news of the account freeze onto their sites. I admire the matrix-site owners who have chosen to work with the pay companies to refund their customers when they closed down their site. Thank you for treating you customers with honesty, dignity, and respect. Shame on you other site owners who are being completely dishonest about what both you and I know is happening behind the scenes.

Due to the Ginix freeze, as you have said watchdog, eBanana will be shut down. This letter is to be sent later today, once I receive a call from my banker. It is odd since it seems like the pefect timeframe from time to a wire transfer being sent till I receive it, but if the wire transfer for the held monies is received, it will be denied and returned to Ginix, where the site's customers will be able to request a refund.

As you have said watchdog, we should 'land the plane smoothly'. Ginix freezing the accounts is quite some turbulence, but we have a schedule which will make it very easy for consumers to get refunds. Customers, DO NOT REQUEST A REFUND AT THIS TIME. You will be receiving an e-mail within the next 24 hours from us regarding how to go about obtaining a refund from Ginix.

Below is a copy of the e-mail to be sent later today:

It is with deep regret that we must send a letter like this, so early in our site’s life. Please read below as this information is very important and requires your full attention.

As many customers have known, matrix websites have been in the news for various reasons – and presented in both positive and negative ways. As matrix websites grew in popularity, so did the media attention and ‘customer base’ of the sites. However, since May, there have been many obstacles to face.

For many months, Ginix was the official merchant of eBanana since March 2003. Since adopting Ginix, we had seen sales increase at a steady and healthy level, helping us to attain our goals for the rest of the year. We had experienced a very good relationship with the Account Executive and were pleased with the service of this company. Ginix had been a highly regarded online merchant, benefiting greatly from the ‘matrix craze’ that has occurred this year, being the official merchant for over 50 other matrix sites, processing varying amounts of revenue depending on site.

eBanana had great faith in Ginix and its operations, and abided by its stringent wire transfer policy and billing terms. Although high, at 10%, we deemed it acceptable, as long as we provided a safe, secure, and easy to use service to our customers. Even with the high rate, in April we had finally began to run a healthy matrix company, with special ‘twists’ not seen on other matix sites. eBanana, through its well-thought out reimbursement plans, was to set up a ‘matrix opt-out program’ for customers who no longer wished to be in the matrix. The eBanana Cash Reserve (ECR) was to be used to help fund this opt-out program, but we could not begin the program until the ECR funds were released from Ginix. (Ginix holds 10% of all monthly revenue as an insurance policy, the entire ECR fund valued at around $1600 was part of that 10%, which was to be released in August 2003).

However, in mid May, things took a turn for the worse as legal concerns facing Ginix arose. Ginix had become entangled in a merchant mess, and conducted legal talks with its counsel to determine the best possible route of action.

On the evening of June 23rd, 2003, Ginix made the authoritative decision to freeze all merchant accounts of listed matrix sites who conducted business with them, and have seized all monies entitled to all matrix sites. Upon receiving a phone call, we had determined that eBanana was one of these listed companies, and all revenues have been frozen.

Ginix has advised us that this is “a temporary measure” that must be taken to ensure that Ginix acts within all legal boundaries, but when looking at the entire situation realistically, we have little reason to believe eBannaa will ever see any of this money. Ginix had taken an unprecedented move by canceling all matrix website accounts. It has now caused a huge mess involving thousands of customers. At this point in time, everyone is disappointed, including customers and matrix site owners, since Ginix is holding all funds and releasing it to no one.

“WHAT DOES THIS MEAN TO ME?”
This means that Ginix, our merchant, has frozen a large amount of money, which we no longer have access to. eBanana is now unable to access our merchant services, cannot look up any personal information, and have no more access to our address database. Fortunately, we have kept a detailed e-mail database of all customers to keep you informed of matters such as this one. Please be advised, that at this time, GINIX IS HOLDING YOUR MONEY.

We have evaluated the current situation of eBanana, and unfortunately, due to this catastrophic decision by Ginix, we are advising customers to request a refund from Ginix. We are currently working on a REFUND SCHEDULE for all customers of eBanana who wish to receive their money back. You will be receiving another e-mail from us soon regarding how the refund process will work. DO NOT REQUEST A REFUND UNTIL YOU RECEIVE THIS LETTER FROM US. It will have specific instructions for customers to go about receiving a refund. You will be required to follow all steps listed in the refund schedule in order to receive a timely and full refund of your money.

WHAT DOES THIS MEAN IF I CYCLED IN MAY OR JUNE?
Since we have not and will not be receiving any money from Ginix, all those who cycled in May and June will NOT be receiving any payouts. May cyclers were to be paid out June 30th, provided we receive our wire transfer, but we have found out that we will not. Similarly, June cyclers were to be paid out beginning July 31st, but once again, since no money will be received, we cannot honor June payouts. Everything would have gone on as planned had these events not occurred, but since they have, we cannot honor any more payouts. The entire matter has been taken out of our hands.

We sincerely regret all that has happened. Learning about this on the morning of June 24th was a terrible occurrence, since everyone has been robbed of something. Not only do the customers lose out by this, but so does eBanana and its employees. Our goal was to grow eBanana into a reputable, highly regarded matrix site, not only offering great deals, but helping out customers. Under our new system, people at the bottom would not have had to wait forever to cycle, those who did not want in the matrices anymore could get out, and many more promotions would have been offered throughout the year. It is a shame we will not be able to provide the same service we have in the past.

As far as I know, isn't eBanana one of the larger matrix sites?

yes, it was, but since most of the money made was during the may/june period, this money is held, meaning little damage has been done. as long as everything goes to plan and ginix refunds these customers without much hassle, things at ebanana should end smoothly by the end of july.

I'm not associated with ebanana but I was curious why you are entitled to a refund? Did they have a refund policy and if so are you entitled to one according to their refund policy?

Please do not interfere in the business matters between eBanana and its customers. For your information, I created the eBanana forum for the matrix sites to glean from their example. For your information, eBanana is no longer operational and they have offered refunds to their customers. Therefore, refund policies are a non issue here. Furthermore, refund policies are a non issue for any matrix site. The customers have a right to a refund no matter what your terms of service say.

I wasn't trying to interfere with ebanana and its customers, I was just curious since I did not know if ebanana had offered their customers a refund.

But I will say this, you are wrong concerning customers having a right to have a refund. They do not if the individual site says that they do not give refunds. And that my friend will stand up in court.

Terms of service do not override the law. If matrix sites are deemed an illegal lottery, your terms of service will be meaningless. Furthermore, whether or not you offer a terms of service, the customers can still go through their credit card companies.

Yes that is correct they can go thru their credit card companies which every body does way to often so that they can get something for nothing.

They invest in a site knowing fully well that there is no refund, but hey if they don't cycle in a reasonable amount of time, hey why not just contact the credit card company and request a refund. Hmmm.....

So who is scamming who.....?

Chris, you had been sent a refund request form from us numerous times, it is not up to us to fix your internet so you can receive these e-mails from us. Please post in the eBanana sub-forum from this point on.

RSient.com is temporarily closed for business. Due to some misdealings by former owners RSiENT.com has suffered severe financial loss. (I have personally paid in over $6000 of my own money to try and keep this business a float.)

On top of that an account freeze by Paypal makes it virtually impossible to continue operating without people losing money.

. As outlined in our terms of agreement we will refund all money received in the last 10 days including membership fees.

They state that the people in the last 10 days can bet a refund.

I bet after the people on their lists see this, there is going to be a run on paypal for refunds from them.

Hopefully they can get refunds from paypal, depends if there is any money in the account.

See it just takes a little time but more will fail. They can't survive if they have no buyers for the lists.

the problem is that no one signed up in the past 10 days, so they will probably not be issuing many refunds.

Those lists hadn't moved in weeks since the auctions were taken off ebay.
