If you were a YMMSS Member and you wanted to take legal action against YMMSS what and how would you do that? Even if YMMSS offered to give you a refund, if you were still so upset that they were doing what they are doing to so many people, how would you go about doing it. In other words, can people here help/give advice to upset YMMSS Members on how to take legal action?

A couple years ago, a handful of us got together and asked a similar question about the "matrix scam" which was plaguing the internet at the time. The lawsuit were extreemely successful in raising media awareness and public support of our cause, as well as in granting refunds and restitution for thousands of matrix-scam victims. We wish the YMMSS folks the best of success in their endeavors.
The best way to go about this is to type up a letter comprising two short paragraphs - one detailing what YMMSS is all about, and how much money they have raked in, and another paragraph describing your experience and what you want to do (i.e. file a lawsuit).
Then, go to some websites such as Lawyers.com and just start sending it out to consumer-rights attornies and anyone else you can find. Also, contact some of the most powerful lawfirms in the country (Skadden Arps, etc.) and send off your letter to their people.
You will find that many attornies have varying opinions on the issue, yet eventually you will find one who will be willing to take your case. If you find more than one who is willing, then go with the attorney who has the most demonstrated success in this area of the law (ask to see their case history). It really only takes one lawsuit to get things going. Once that happens, you will see all kinds of people rallying behind you and even filing other lawsuits.
Be sure to also contact the Attorney General for your home State and get them as involved as possible.
And just as a disclaimer... I (and we at MatrixWatch) are not attornies, and you will need to contact an actual attorney to determine whether or not you have a case.

Watchdog makes a great point about the way that we approached the matrix sites, and it worked very well. Bringing together a group of people can make all the difference in gaining exposure, and more importantly, getting justice, and I think we have been successful in bringing many of the victims here, even if they do not post here on MW due to being scared of any retribution (which in this day and age, is a very unfortunate thing).
Matrixwatch is willing to assist the victims of YMMSS in starting the wheels to get this process going, but the victims have to be willing to come forward. We have contacts at the state Attorney General's office for the 50 states, plus the US Attorney General's office as well. And as watchdog stated, putting together a proposal with what the program was all about, and how it has gone wrong financially, and submitting it to attornies online is the best way to find an attorney willing to take the case. One of our advertisers is LegalMatch, who do just that, for no cost up-front.
To answer the question at hand though ... if I were a YMMSS member, I would be angry at this point looking at the lies and deception put on by the owners and 'ranking' investors. Depending on how much money I had put into it, and what I was promised in return, I would want my money back, plus some damages. The reason I think about damages is because thats money I could've had in stocks, CD's, or in the bank, that lost interest and value because it was tied up in an operation full of lies and deceit. Someone else made money off my money instead of me, thats not right, and I would expect to be paid back that money plus the loss I took.
Regardless, anybody interested in starting a movement as is stated above can send me a PM, or email me at jokach@matrixwatch.org if you're not a member here due to being scared. We will help to coordinate it initially, but will need the involvement of others to go the full way (in providing proof, damages, promises, etc).
The power is in the victims hands to stand up and be heard, and make the difference. We can empower the people to make that difference, and continue the fight for justice!

I would gather up all of the conference call minutes and start to pick out all the times Kim has lied and been wrong. You will only be able to go back to March 05 in the YMMSS archives becasue the funny thing is that all conference call records before that some how got erased. (Unless you know some one who has been keeping them on their personal computer before they were deleted from the archives)
You can go back to 9/27/04 on this site http://www.oshkoshhandyman.com/calls.htm
I am sure there are members out there that have kept nearly all conference calls and written anouncements from Kim.
This would take some time but using Kim's own documented words would be a good place to start a case.
