The Massachusetts Attorney Generals office is seeking an emergency court order to shut down NEPCO LP and NEPCO GP, LLC for engaging in deceptive practices, the actual announcement is here (from the AG's website):

BOSTON - Attorney General Tom Reilly is seeking an emergency court order to shut down a Waltham Internet company that bills itself as "The UK's Best Source for Digital Video Equipment." The company is not based in the United Kingdom, but in Massachusetts, and misled and overcharged dozens of consumers, most of them British.
The lawsuit, filed today in Suffolk Superior Court, accuses Jeremy Paradies of Waltham and his companies, NEPCO LP and NEPCO GP, LLC, of routinely engaging in deceptive pricing, overcharging customers, failing to deliver merchandise, failing to give refunds and frequently shipping wrong orders. Paradies and his companies sell a variety of electronics, including digital cameras, recorders, plasma televisions, iPods and video game equipment, using the domain name mydv.co.uk.
The site, despite its Waltham location, prominently displays a London-based telephone number and lists all of the product prices in British pounds sterling.
AG Reilly's lawsuit alleges that Paradies charged more than the advertised prices on the credits cards of British-based consumers who ordered goods online. Also, despite the website’s promise of "impeccable" customer service, mydv.co.uk failed to respond to consumers complaints and failed to refund overcharges charged to consumers' credit cards.
According to AG Reilly's complaint, the website either failed to deliver goods consumers were counting on to give as gifts for the holidays, sent the wrong products, or, in some cases, sent merchandise intended for the Japanese market with manuals written only in Japanese and power sources which did not conform to UK standards.
Assistant Attorneys General from AG Reilly's Office will be in court today seeking a temporary restraining order and a permanent injunction to stop mydv.co.uk from advertising, promoting or offering for sale digital and video equipment, consumer electronics and accessories as well as requiring it to pay civil penalties and restitution.
Assistant Attorney Generals Scott Schafer and Margret Cooke and investigator Eric Funk of AG Reilly's Consumer Protection and Antitrust Division are handling this case.

This is exactly the kind of outcome you see when people band together and work toword a cause!!! Many thanks to all the MYDV victims who took action and filed complaints against this company.

Assistant Attorneys General from AG Reilly's Office will be in court today seeking a temporary restraining order and a permanent injunction to stop mydv.co.uk from advertising, promoting or offering for sale digital and video equipment, consumer electronics and accessories as well as requiring it to pay civil penalties and restitution.
Note that civil penelties could suggest that those folks who are victims of MYDV might get some sort of financial reimbursement for their trouble. That is fantastic news. :applause: :bow: I hope it puts a stop to this companies antics.
It is also a very pleasing thought that complaining to the right people gets action and that as one of the folk who did write to the Atorney Generals office in Massachusetts I made a difference.

P.s. The people at the Atorney Generals office will probably still want more evidence to take this to a conclusion so write in if you haven't done so already.

I wonder what will happen about refunds that have been promised and are in the pipeline?? I have an email confirming my refund is in progress!!

If the refund is truly in the pipeline then it will be with the clearing banks to process which means its out of MyDV's hands and should come through.
If not an injunction my disrupt the process. I assume you will have paid by credit card and you can submit a claim via them to get your money back.

Yea, im a little worried about that too, would we get reimbursed? as if this goes ahead then i cant see thm sending out the remaining orders

If they get shut down permanently ( and I hope they do ) there will likely to be a process for refunding all the outstanding orders etc. However, not being familiar with US law I don't know how long this would take or if any compensation would be in full.
I expect it would be quicker and easier to make a claim via your credit card company for a refund due to non-delivery of goods/ company going out of business. Don't panic, in the UK the credit card company is liable to pay in these circumstances after a 30 day period from ordering you will get your money if you make a valid claim. Get in touch with them now if you haven't already done so.

I understand this news may worry some people who have outstanding refunds or have been waiting for delivery of the goods. These guys need to be closed down part of what they MA AG is doing will be to secure funds for victims its seems so there may be money from that direction, eventually although legal matters can take quite a long time to complete.
The more likely swifter course of action is to claim your money back via your credit card company and the legal action may even speed this process up.

As the contract of sale is jointly between MYDV and your Credit Card company for goods valued at over £100.00 you should have no problem getting your card refunded.

Merc is so right on this one. Keep moving forward with your complaint filings.
When these annoucements come out, people have the tendency to declare victory and wait for an outcome that never arrives. You must continue to be proactive. That means contacting your CC company, filing complaints, and doing whatever it takes to fight for your rights (and your money back).
These court orders only help to justify your complaints to your CC company, to law enforcement, and to the media. Keep moving forward, and don't call it quits yet.

From what I've seen over the past couple years, people put too much faith into annoucements like these. There is the possibility that it could be reversed, or that MyDv could settle out.
You can be happy about the recent annoucement, but after the party you've got to keep moving forward. Start filing complaints with other agencies, contacting more media outlets, and getting the word out.
If there is one thing I've learned, declaring victory too early can result in things getting worse down the road.

has anyone been able to contact MYDV at all in the last week?
unfortunately I put in an order last weekend :mad: . I have not been able to contact them at all via phone or email and the messenger service doesn't seem to work at all. looking at posts some people seem to have some success with the message system??
when I put a message in nothing happens at all, the window just disappears?? is this a common experience? I know this is not my pc because I tried the service to the site of the company that produces the message s/w liveperson and it worked fine.

Contact your CC company, and tell them about it. They might be willing to process a chargeback for you, which usually results in you getting 100% of your money back, and your CC company does the work of getting in touch with MyDv.
If MyDv doesn't contact your CC company, then they get penalized.
This way, you aren't sitting on the phone for hours, and you can just get your money back and relax for the holiday. Credit cards give consumers purchase protection for exactly this sort of issue.

Yes I agree. I don' think I was declaring victory just pleased that it appears the temprary injunction is in place and an expression of hope that the MA AG is more successful still.
I seriously doubt if anyone has lodged complaints with more agencies/organisations than I have. I have got all my money back a while ago but I am still in this to make sure that this company either shapes up or is closed down. What they have done to people is wrong and justice needs to be done.
Either way though this is going to hurt them. The more that happens the more other companies won't want to deal with them. The credit card companies and clearing banks are going to get fed up with the increasing number of chargebacks. Other companies like DHL and other carriers aren't going to want to deal with them either.
I absolutly agree that this is not the time to back off quite the reverse more pressure on them needs to be brought to bear. So, anyone who hasn't lodged a complaint should do so now.

I have had several emails from them saying that my refund was being processed and should be in my account within 5 working days. Nothing ever was refunded.

I've heard that when it is refunded, you don't get 100% of your money back. This sort of trouble is why many have resorted to filing chargebacks with their credit-card companies.

There are two e-mails which I saw about my refund, the second, which was from the "NEPCO Refund Department" was the one that came just before the actual refund and says it should take two to three days... Other people said this was the case for them as well...
