I did what the rest of us have done and got caught napping when ordering from myDV.. I ordered a psp on 12th nov, got overcharged by £20 (not much but its the principle)..and yes youve guessed it ..i am still waiting...Numerous phonecalls and emails have been sent to them..(i am dreading my next phone bill) all to no avail..they are elusive and unobtainable. I want to cancel my order but cant get through to do so. I want my money back but paid by debit card not credit card.. I have done all the usual stuff, filed complaints with the MA AG, contacted everyone i can think of to contact, and have sent notice of intended legal action on several occasions to all the contact email addresses..
We are 5 days away from xmas and i have no psp for my son, and no money back as i cant cancel..
I feel like this is a bad dream..and i am beside myself with guilt for ruining my son's xmas for not being more vigilant..how do you explain to a 10 year old that santa isnt coming this year cause mummy has been a fool..
I just dont know what to do next...
any suggestions guys?? :weep:

Hi Misty,
The thread below should give you some hope:
http://www.matrixwatch.org/forums/showthread.php?p=31115#post31115
The only advice I could give is to get down the shops if possible and get a psp locally.
Dont let MYDV spoil your christmas as i suspect there are hundreds people in this position.

Debit cards sometimes come with the standard purchase protections of a normal CC. You should contact your bank's dispute department and ask them to process a chargeback.
And if UPS/DHL/FDEX delivers the package, be sure to refuse it and have it sent back to MyDv. Don't accept it and open it, because then you'll be stuck with the fees to ship it back. And trust me, it probably isn't even what you ordered anyway.

Hi Misty,
If you call you bank first thing in the morning and explain the situation, as MYDV have withdrawn £20.00 more than authorised this should be enough to throw the whole transaction into dipute, and you may receive the funds back very quickly.
Also give citizens advice a call who may be able to help more with individual cases and give better advice than I can.
Dont give up and the best of luck.
Let us know how you get on.

guys you are stars...many thanks...
I have just got off the phone to my bank 24hr helpline.. I told them my woes and they have asked me to go in to my local bank and file a chargeback dipute claim form tomorrow.
They have said that the process is as follows, i file a claim the bank refunds my money and then pursues a chargeback from myDV which incurs a penalty charge.
They said that the only risk is that if it unsucsessful then the bank might retake my money from my account..
Is this correct?? Can they do that or are they covering the backsides??
Anyway i am off to the bank first thing..I am unlikely to get anything before xmas now but its a start. and a possible light at the end of the tunnel..
I will let you know how i get on tomorrow..and i the mean time i am firing off copies of a cancellation request emails to all the known addresses for this company..Which i doubt they will acknowledge.. :head:
I really appreciate the help.. Many thanks.. :)

Here is how the process normally works:
The bank temporarily credits your account for what you were charged by MyDv.
They then investigate the situation to see what the story is
If the charge was actually legitimate, then the credit stands. If the back concludes otherwise, then the credited funds remain in your account; mydv receives a "strike" with their processor and (usually) both mydv and their processor are charged a penalty fee.
So, the big question that you probably have is, "What can I do to make the chargeback stand?" First off, be totally honest (but brief) with your bank. Tell them that:
a) The charge is not accurate, and you are thus requesting a chargeback
b) You did some investigation and found that the Massachusetts Attorney General has filed a court order against MyDv for causing this same problem for many consumers.
You might want to see if any of the other members here can help out with any other details to give your bank through this process.
Hope this helps you before Christmas! If I could offer any hope for the future, let me quote from a message left by another member of MW:
From this thread (http://www.matrixwatch.org/forums/showthread.php?t=3515)
I've just checked the balance on my credit card and was pleasantly surprised to find that they have refunded me the whole amount of £183.00 that was paid to mydv.
I'd like to thank everybody on this forum, who gave such good advice about how to claim your money back from your cc company, only for finding this website I wouldn't have known what the hell to do, and would have thought that was the last i'd seen of my £169.99 that turned into £183.00 forever.
Everyone just hang in there, if you have all paid by credit card which I suspect you all have, then don't lose heart, contact your cc company and they will do a chargeback...

Yeah, you're probably right. I'd just let the bank go through that trouble. What is most important is that you get your money back, and you leave the digging to someone else so that you can enjoy your holiday. I'm also glad to see that the community here at MW managed to help you solve your problem in about an hour. :) We really do have a dedicated group, and I hope that when you get this matter behind you, that you can help to reach other people who come here with a similar situation. :applause:
Also, in light of several recent posts on this subject, I've decided to write a quick snippet about the power of the chargeback (http://www.matrixwatch.org/forums/showthread.php?p=31253#post31253)
But Misty, could you do the community a favor? When you have the time, could you please file a complaint with the MA Attorney General? Here is the link to the PDF: http://www.ago.state.ma.us/filelibrary/ccboth.pdf This will help the government ensure that this same thing doesn't happen to others.

Misty,
dont blame yourself for ordering from MYDV.co.uk. like everyone else you thought you were buying from the UK.
The MYDV site is designed to make you think you are purchasing from a UK company, they even have what looks like a London phone number.
Good luck with your bank complaint.

consider it done...its the least i can do..
well do you want to hear the update...after an hour on the phone repeatedly using redial i eventually got some-one to answer the phones...(probably gave them a headache.. :applause: )...i got the usual story...blah blah blah...then was told it had been dispatched ...blah blah blah...i told them i didnt care whether it had been dispatched or not i was cancelling my order and wanted a full refund for the amount plus the overcharge...more rambling and waffling by the Indian man...followed by the offer of a refund of the overcharge plus a goodwill gesture of £10 for the trouble and delay...wow...huge token of goodwill considering that the token payment would be somebody elses overcharged money they were trying to buy me off with...!! :shake:
after i told him i couldnt care a fig wether he promised me all the tea in china i wanted to cancel and that was that...he told me...wait for it...
that the order was not with them...i said tough thats your problem i am cancelling, and refusing delivery if it ever arrives, and i want a full refund...to which he replied...i will refund the overcharge, plus the £10 goodwill money and hung up on me... :nono: i could not then get back through to them... so i doubt it has been cancelled and will have to repeat the process again tomorrow...this is a joke... :weep:

What about the chargeback you filed with your bank? I thought that the reason for filing the chargeback was so that you didn't have to go through the hassle with MyDv.

Hi Misty,
As you are still having this hassle with MYDV, to avoid the call centre problems (I wouldn't be surprised if MYDV use the same call centres as some UK Banks) The best course of action I would reccomend is to request a meeting with your local bank manager (or even better go in to your bank with any copies of MYDV correspondence etc you have).
Inform your Bank Manager that you consider the transaction is unsafe and wish the funds credited back to your account.
You may have to sign a declaration but as MYDV have removed unauthorised funds from your account (£20 overcharge) this shouldn't be a problem, also request a new Debit Card and your old one cancelled.
Hope this helps.

thanks for the continued support guys...
Yes i am still having agro with myDV...got on the phones at 7.45am this morning by 8.00am my call was answered ...managed to cancel the order by phone and demand a full refund including the overcharge..
Then two hours later i recieve an email from them saying my order would be dispatched shortly via DHL priority shipping...i couldnt believe it...got straight back on the phines...the guy said the usual..that my order was made on 12th nov blah blah blah...then tried to promise me delivery before xmas...i asked how this was possible as the order had been cancelled that morning...he said that he didnt have that info :nono: ...i assured him that i had proof it was cancelled in the form of a taped conversation :) ....i asked him to update his records whilst talking to me...then got him to confirm the date, company name and that i had canceled my order then informed him that i had just recorded all that for future reference :applause: ...one very quiet man on the other end...!! lol i thanked him for confirming cancellation and demanded that a refund was given within 7-10 days..and hung up..
I have been to my bank and filed a chargeback claim...it is being dealt with and may take weeks i have been told... :shake: :weep: if myDV refund my money then i will inform the bank of this fact..
so i am still no better off at the minute...no psp...no money and one very upset son on xmas morn...
thanks a bunch myDV...hope you have a very unprosperous new year.

The chargeback is usually posted immediately. The bank's research into the situation is what takes weeks. If I were you, I'd see if the chargeback was posted to my bank account.
Misty, honestly, I wouldn't be sitting on the phone any longer with MyDv. And I would REFUSE the package when DHL comes to your door.
Which brings up an interesting point. Why is MyDv shipping via DHL again? I thought that DHL cancelled their services to MyDv on account of all the complaints.

DHL told me they would not knowingly deal with myDV, i.e. if myDV are the people who ship the order...
However, as myDV are going through another company (Kuehne + Nagel) for shipping this does not stand.
Pretty frustrating!

Misty Watchdog is right the banks chargeback is the best way to proceed with the issue let themm do the hardwork but make sure you provide them with enough facts to make it stick.
In anycase continuiing to deal with myDV direct may cause problems with the chargeback process and give your bank an excuse.
Refuse to except any delivery of the goods as the courrier is them responsable for sending back.

Im in a similar position-
Ordered sony dcr-hc33e (259.99) on nov 22.
Realised overcharge of 6.95 two days later.
Emailed twice to cancel. (heard nothing back)
Cancelled my card with Barclays - so no more charges could be made by mydv.
On dec 6 Barclays notify me that mydv tried charging my cancelled card the full amount (266.94) so I notify Barclays of situation and logged it with them as fraud.
On dec 20 the full amount has been debited from my account to mydv.
The same day I recieve an email from sebastian at nepine claiming the shipment is being processed.
Dec 21 - I email sebastian back demanding cancellation and refund.
Dec 22 (today)- I recieve another email from richard at mydv stating I need to phone them to cancel.
So- one month on - Im out of pocket 266.94 - dont know what barclays are doing about it, presumably- they have allowed the charge to go through? dont know if theres any point trying to call mydv- as i have had no luck phoning to date.
Anyone else in this boat?
This whole experience with mydv has been truly exasperating, expensive, pointless and frustrating. I have wasted so much time struggling and worrying about this- its just a joke.
in the meantime- i ordered the same product at the same price from rgbdirect.co.uk- and i got it two days later! I did all the research into the product- but not mydv.co.uk. Was duped by google and the impressive mydv.co.uk website and claims.

I think Watchdog brought this up before, but we need to make a FAQ for mydv customers that come here. We can then put those FAQs on a sticky thread, and direct people to them.
Who wants to help create this FAQ? I'll start with some of the questions....
Q: I ordered from MYDV, and have not received my goods. Will I receive them?
A: Yes. You will receive your goods (eventually).
Q: I have heard that MYDV is shipping from the United States. Is this true?
A: Yes.
Q: What can I expect from the goods I receive from MYDV?
A: Many, many customers are reporting that goods received from MYDV are not UK-spec. This means that camcorders are coming in the NTSC format, Playstations are coming with US power plugs, items are coming with Japanese instructions, etc.

I'm wondering if Misty understands that the item she is expecting in the mail is actually a non-compatable product. Which means that, if she doesn't refuse the package at her front door, she'll run into the problems of:
1. Finding out how to return it to MyDv (nobody can find out the right address)
2. Requesting a refund and only getting back 95% of the money (which is happening to everyone).
Misty, trust me, file that chargeback and refuse the package immediately when it arrives. You will only invite more problems upon your holiday.

I received a refund from my credit card company for the psp I ordered from mydv on the 11th December, low and behold a DHL van pulled up outside my house today with the said PSP, when I answered the door I told him that I was refusing to take delivery of the package, he told me I was the 2nd person to refuse today, to which I replied you will find there will be a whole load more people refusing to take delivery before your finished. He asked what the problem was and when I told him he looked at me as though I had two heads, anyway he wrote refused on the sheet he had and then asked me to sign to which I declined and off he went.........

Awesome. Now you won't have to go through the hassle of finding where to send the returned package, which probably contained a Japensese-version PSP anyway.

Watchdog....trust me i have no intention of accepting that order when it finally arrives....i have drafted a reciept to get the delivery driver to sign to prove that the goods are being refused and returned to the original shipper.
There is no way on earth i will take the package from the driver. and as an added precaution i will take photos of the package being taken away.. There is a big note pinned to the inside of my front door instructing everyone not to accept any packages and to get the driver to sign this reciept, incase i am not here when its delivered..
the chargeback has been filed already and is in the process of being investigated....
The bank credited my account with the funds yesterday whilst the investigation runs its course.
I have been a bought a UK spec psp from woolworths....hassle free, and with a UK Warranty... :applause: lol
Thanks for all your help guys i am in your debt for the heads up on what to do regarding myDV.. so glad i found this site.
