I'm yet another myDV victim. Goods ordered 29/11 and expected before haven't yet left the warehouse. I've only today discovered what myDV really is. Payment was made by visa card so I'll be pursuing this with them also.

Hi
I have also been waiting for an order. As I my suspicons were raised I enquired on how to cancel my order by contacting them on thier live chat. They told me this could only be done by phone. This discussion has gone on over 24 hrs. below is a transcript of my converation, during which I also had trading standards on the phone.
Sandra: Welcome to our live chat service, allow me to introduce myself as your chat representative.
claire: How long does the order take from leaving the warehouse to reaching the customer?
Sandra: It takes 2 business days.
claire: In which case you will have a tracking number for order # 24559
Sandra: Your order is currently being processed at the warehouse and will be shipped out as soon as the warehouse sets a shipment date for you; also you will be emailed that information
claire: I have enquired about cancelling my order and was informed to phone 02079934698, but as it is imposible to get through what other ways can I cancel my order please?
Sandra: Calling us is the only way to cancel an order.
claire: According to trading standards this is not true. If the order can be placed on line then it must also be possible to cancel the order on line.
Sandra: No, we need a verbal consent to cancel an order,.
claire: but this is impossible as your phones are ot manned and the mail box is full. I want a tracking number now or a cancellation confirmation please.
claire: hello?
Sandra: Please call us.
claire: there has been NO answer for over 1 week!
Sandra: Please call us in the afternoon.
claire: I have tried
claire: legally my cancellation needs to be in durable form. i.e in the form of a letter or e mail. i am on the phone to trading standards as we speak and i am acting on there advice.
Sandra: Is there anything else I can help you with today?
claire: under the business names acts I am making arequest for your registered trading address
Sandra: I am not authorised to give that address.
claire: i look forward to my refund.
Sandra: Please call us.
Then after looking at mydv-ripoff website I had the next conversation with them, although I have not had my refund yet, this is the first time they have accepted my cancellation and confirmed a refund. Aswell as this I have sent copies of my request for a cancellation to my credit card provider. Apparently under the "section 75 consumer credit act 1974" the credit card providor is equally liable providing you have made a cancellation request to the trader in writing.
this is now the second conversation- I am retyping it as for some reason I cant cut and paste it.
Claire:Hi, have you checked out www.mydv-ripoff.co.uk. according to aothoriites in the UKit seems you have ripped off one to many people and you are under investigation for fraud. This will be my last request for a full refund to my credit card before I commence legal proceedings.
Lisa: I am aware of that. It has been escalated to my executive management who are looking in to & will have this resolved asap. rest assured that all existing orders wii be delivered.
Claire: order #????? has been cancelled, and as you should be aware unde the consumer protection (distant selling)act you have 7 days in which to cancel my order. You then have 20 days to refund my card in full.
NO RESPONSE FOR FIVE MINUTES
Claire: can I take that as confirmation of the cancellation of my order and a refund of £155.95 or shall i authorise for legal proceedings to commence?
Lisa:Yes
Claire:will the refund be done immediately?
NO RESPONSE
Claire: WILL THE REFUND BE DONE IMMEDIATELY?
Lisa:yes. however it usually takes 7-10 days for it to show up in your account.
This is the first time they have accepted my cancellation. I have two previous heated conversations with them but unfortunately do not have copies of.
I hope this is of help, and you get your refund.

I wouldn't even bother contacting mydv for a refund again if I were you, because believe you me they have got no intention of giving you one, all they will do is keep fobbing you off by telling you your order is cancelled and then you won't receive any refund, just contact your credit card company let them deal with them, believe me this is the best course of action.........

Dear all,
Just a little word of encouragement. I have been involved with this since October 14th, and there are a lot of people who have received refunds. In my case I eventually received a full refund for my item that cost over £2000. So it has happened a lot. The trouble is that these posts are now so numerous, that it is difficult for new victims on MatrixWatch to get an overview. However, raher than me repeating stuff, new victims really should spend an hour or two reading these theads - it really will inform you so that you can make an informed action plan depending on your circumstances.
The bottom line is, you WILL get out of this mess, but your success depends absolutely on determination and never giving up.

Perhaps some members of the MyDv community could get together and write one good sticky post for new members?
The title could be something like, "What MyDv Victims Should do if...", or "10 Simple Steps to..."
That would be extremely helpful, and when new people ask the same questions, we can just start referring them to that post.

Good idea watchdog! We already have some informative stickies, but nothing quite like what you described!

I too have been waiting for an order to appear, only to keep getting fobbed of with excuses that it has been dispatched.
Then I came across a blog from Longrider and found a contact number for MYDV.
Apparantly this guy called Kurt has been telephoning people after they have cancelled their orders to find out why(a kinda customer service I suppose.......you can all stop laughing now) and this phone number appeared:- 001 312 224 1676...........so I called and asked to speak to Kurt and when asked what about I told them he had telephoned me about my order.......and then I found out that it had never been dispatched.........I think the guy had had enough of people phoning as he sounded very pi%%£d
off........outcome is apparantley I am going to get a refund.......although I like breathing so I am not holding my breath.
