View Full Version : MYDV (Nepco) lawsuit update

I have just spoken with the Attorney General's office concerning their filing against Nepco LP and Jeremy Paradies. They have stated the attornies for Nepco and the AG's office have entered into a stipulated agreement in order to LIFT the "emergency court order" to shut down MYDV immediately, which means that this stipulated agreement will allow them to continue doing business under these terms until the actual lawsuit is heard. This is stuff that we already know:
1. all orders must be fulfilled or refunded by Christmas.
2. They must advise customers that they are headquartered in the United States
The lawsuit that was filed was NOT settled, I repeat, it was NOT settled and will be heard by the Suffolk County Superior Court sometime in January (at this point). Again, the above was agreed upon so that MYDV can continue to operate pending the further litigation.
We are currently in the process of obtaining additional details on the case, inlcuding hopefully a copy of the actual lawsuit that was filed. As soon as we have the court date and the docket number, we will share it with anybody interested.

Why hasn't the AG mentioned any motions concerning:
- The shipping of "gray" products that were not clearly advertised as such.
- Overcharges upon purchase, and only partial refunds when the order is cancelled.
- Lower declared values on international shipments to avoid higher tariffs
- Malicious targeting of discussion forums out there which brought these issues to the AG's attention in the first place.

I'm waiting to see the actual lawsuit to see if they are included, and exactly what was included in it.
Two important things that I want to mention with this new information:
1. Keep filing complaints to the Attorney Generals office! They are listening!

I have just sent the AG another email highlighting my concerns.
Dear sir,
I am one of the many concerned and angry victims of the company myDV a subsidiary of Nepco. I have written to you on a previous occasion highlighting my concerns and outrage at this systematic abuse of trust, and fraudulent taking of funds from its customers.
My position is the same, i am still financially at a loss, and have not received goods which have been paid for some 6 weeks ago.
I understand that the Attorney General has entered into an agreement with Nepco to lift the restraining order on them and allow them to continue trading providing that they fulfil all outstanding orders by Christmas, or refund any monies owed on cancelled orders.
I am writing to inform you that they are still not conforming with the sanctions imposed on them.
Today is 24th December, I have not received any refund for the cancelled order, and have had to rely on my bank to claw the money back. This is entirely unsatisfactory. I am aware that there are other UK customers still waiting for goods or refunds.
So as you can see they are clearly breaching the agreement with you to refund all their victims before the holiday season. This outrageous company should be shut down permanently until they can prove they have the recourses to meet demand, and that their deceitful business tactics are changed.
Please also be aware that there is no mention of the fact that the goods they are shipping do not conform to Uk standards and are therefore useless.
Also there is the small matter of UK tax evasion which they are systematically avoiding by lying about the shipment value.
