Many thanks to Peter at mydv-ripoff.co.uk. The kind of action he is taking is a good example of how a focused consumer can make a differnce.
In any event, here is the update from his site:
News Update 30 December 2005
Assistant Attorney General Scott Schafer left a message on my answerphone yesterday to say that the Massachusetts court has made an order against myDV which demands that it must meet all back orders as of 16 December 2005 by the 31 December, before it can resume taking new orders.
The fact that the mydv.co.uk site has now removed the notice from its website advising customers that new orders were temporarily suspended, must mean it has met all those outstanding back orders. If you are a customer who has NOT yet received your order which you placed BEFORE the 16 December, then contact the Attorney General's office to complain, either by phone 001 617 727 2200 (dialing from the UK) or by email scott.schafer@ago.state.ma.us.
Scott also said in his message that myDV had agreed to meet another condition specified in the order relating to currency conversion. This means that myDV will no longer be allowed to levy unauthorised surcharges on customers' orders, and that if there are any extra charges relating to currency conversion, or any other issue, then the customer MUST be notified beforehand so that they can then decide whether to go ahead with their order, or to cancel.
I'm hoping to call him back this afternoon and talk with him directly, in order to get all the details of the court order. I'm posting this partial news straightaway as it is such a good development in our fight to get this fraudulent company to behave decently and honestly.
I will post up here all additional information I get from talking with Scott, once I've got it.

Hi all
Relating to this article today from mydv-ripoff can someone clarify something form me;
If I ordered on the 12/12/05 and cancelled my order by the 16/12/05 should I have had my refund from mydv by now according to this news today.
Mydv have told me that my refund is processed and I should recieve it tomorrow however I have heard this before.
Should I inform th AG that I have still not had my refund by using e-mail address as shown today
Any information would help

It sounds like you should contact their office today. They shouldn't be accepting new orders (which I think they are) until all products are received and all refunds processed.
Technically they have until End Of Business tomorrow, but I imagine that they should not be open for business until after that time.

Have just mailed AGs office and made them aware of my situation and of other customers still awaiting goods and refunds

It sounds like you should contact their office today. They shouldn't be accepting new orders (which I think they are) until all products are received and all refunds processed.
Technically they have until End Of Business tomorrow, but I imagine that they should not be open for business until after that time.

They are very much taking new orders. I have just contacted there online support and they promised me if I ordered today I would recieve the item within 7-10 working days. I then phoned them and was told the same.
I have just sent an email to scott.schafer@ago.state.ma.us making him aware that they still owe me £840 (order value £799.95)
When I phoned mydv this morning and argued my way to the top of their customer services he told me that the finiance department wasnt even open untill Monday the 2nd!

Im hoping to get a reply from Mr Schafer, when I do I will include that along with a few other snippits.
Including when you phone and make a general enquiry or make an online enquiry, they are happy to sell you something and offer 7-10 working day deliveries, if ordered today. But if you phone up and ask the outright "Are you taking orders" They say no. So they obviously know they are not suppose to be taking orders and lie when they think they may be caught out.
Plus there online ordering is working fine as far as I can tell. Because before when they had the notice on the front page saying they wasnt taking orders, the online ordering said something similar. Now it seems to work fine. But I cant test it all the way through without entering my card details. As you can imagine thats not something i want to do.

I ordered an Ipod Nano on the 6th Dec and was gauranteed it before Christmas, didn't get it (not expecting too either) so sent an email threatening with legal action on the 20th Dec. Phoned myDV this evening just out of curiosity and guess what......my Ipod is on it's way, along with a tracking number which of course I have checked on dhl.co.uk and apparently it is at Maidstone, Kent depot so should get it tomorrow I hope, but all this is no good now, as I had to track one down on Christmas eve, so looks as though ipod is gonna find it's way on ebay, can't be asked with the hassle of returning it :head: :shake: :bow:

You've no need to return it yourself, just don't accept delivery from the DHL courier if it turns up he will just put refused on his sheet, but don't what ever you do sign for anything just tell him to take it back from where it came from and claim your money back via your credit card company

I can understand what you are saying, but the problem I have is that the ipod was purchased using my mums debit card (not credit), the bank says that we have to wait 30 days before we can do anything, and to be totally honest, i can have the ipod sold on ebay or to a friend for what i paid for it before we can approach the bank. When it arrives, i will open the package while dhl driver is there to check whats inside, if not UK spec, then I will refuse the parcel, don't want to sound as though myDV are getting a pat on the back, just want to pay my mum back the £130 I owe her.

Merc - I think you wil find you can refuse it after you have inspected it. It is often offered by the delivery drivers for you to inspect an item properly before accepting it. This often involves "taking the lid off" to ensure something is not broken or missing.

So do you think that when my PSP comes i may be able to inspect it before i sign for it :) I do hope so see if it looks as dodgy as some people say it looks :applause:

I would say if you open the actual product packaging it is by default open. I wouldnt sign anything, agree to anything. Worse case scenario I would just slam the door in his face.

Nice idea i am pretty anoyed with DHL as well :rant: because they have lied to me as well (and even lost my friends package) :eek:

That's what I was going to do if the DHL courier insisted I take the package off him just shut the door in his face..... :crazy:

Refuse the package. Don't inspect it. The driver will not wait for you to do so, and you'll need to schedule a whole new pickup.
You can be 99.9% sure that the PSP is non-UK compatible. By opening that package, you are inviting a lot of problems upon yourself.

These theives have not answered one of my mails. I have told them, and showed them my communications with the AG and his assistant today and yet they still ignore every single mail i send. the only communication i have ever received is an order confirmation stating an amount which they took more than. What have you done (personally) to bring MYDV to justice. My current stance on mydv victims is that they need to stop ONLY talking about their troubles, and do something about it. A single complaint to the Attorney General is a start, but I have laid out a full plan of attack....I'm wondering who is willing to take up the challenge.

Write again to thAG office, telling them this. I check everyday that MyDV are still trading and write an email every day telling the AG that mydv are still trading and have still not made good on my camera or refund

You guys are probably going to get upset at me, but I don't advocate SPAMming the A.G.'s office either. When you do that, they end up ignoring emails. Imagine how many emails they are getting about MYDV everyday. They can't read them all. We want to send them a lot of messages, but not all from one person.

i have also managed to call my dv today i spoke t one "Micheal" who said that i would recieve my order in 2-3 days. This seams to be their standerd answer he also said that i should recieve a DHL tracking number by 2pm well its 2:03 and i havent got anything! I wonder if it will come. Are dhl still shipping mydv items?

:crazy: No, you won't recieve a number for about 2-3 days not the item!!
I'm not sure if you will get the item as i have been lied to now by DHL but i have a Thread about if DHL are shipping myDV items (http://www.matrixwatch.org/forums/showthread.php?t=3600)
